Question: "Machine guns! I thought only the police and military could own those?"
Answer: The legality of individual citizen ownership of machine guns in the United States is a topic where many people have a misconception one way or the other. To the surprise of many, it is actually 100% legal for law-abiding and qualified citizens to own a fully automatic weapon provided they follow a specific acquisition process and are aware there are a few caveats. Firstly, you must be able to legally own firearms in general and then machine guns must be legal to own where you live (some city/town/state law forbid them). Next you have to understand that machine guns have always been legal to own but they have become heavily restricted by the government over time. Back in the post prohibition era of mobsters and Auto Ordnance Thompson "Tommy Guns", the government required machine gun ownership to be registered at a federal level and transfers of said weapons to be regulated (and a pesky $200 tax assessed every time they changed hands). A big change further occurred in1986 when a monumental law was passed that prohibited any new machine guns from being added to the registry of firearms eligible for civilian ownership. In layman terms, all machine guns manufactured and properly registered prior to May 19, 1986 are legal to own but their ownership and transfer is regulated by ATF. All machine guns made after and/or not registered before the above date are contraband and not legal to own. Ownership of an illegal NFA firearm carries the possibility of significant criminal penalties including jail time.
